Shawn had recently granted a security interest in his power tools to First Bank in order to obtain a loan. After Shawn defaulted on the loan, First Bank hired Gus to repossess the power tools from Shawn’s residence, despite the fact that Shawn had previously sent a letter to First Bank in which he stated that if he ever defaulted on the loan, he objected to any steps First Bank may take to repossess the power tools.

When Gus arrived on Shawn’s property, he looked through the window of a shed in the back yard and saw that the power tools were located in the shed. Although the door to the shed was closed, it was not locked. Gus entered the shed and repossessed the power tools.

Did the repossession violate Article 9?

1) No, because Shawn was not present to object to the repossession.

2) No, because the door to the shed was not locked.

3) Yes, because entering the shed constituted a breach of the peace.
